Legal Question in Wills and Trusts in Florida

Remarrying, need to protect estate

I was widowed and I'm considering remarrying. I have three minor children, my boyfriend has two minor children. He is close to retirement age and has no savings or assets. I have a sizable life insurance settlement in a revocable trust. My home has appreciated tremendously in value and is my greatest asset. Assuming I die first, I want to ultimately insure my home goes to all our children after my new husband dies. What is the best way to achieve that? Also, if I want 75% my late husbands life insurance to go to my own children in the case of my death-and I put that in my will, could my new husband successfully contest it?

Re: Remarrying, need to protect estate

You ABSOLUTELY MUST have a pre-marital agreement to accomplish your goals. Without it, your husband will have a number of rights which he may enforce against your estate if you predecease him. See an attorney right away.
