Legal Question in Wills and Trusts in Florida

My stepfather died and left everything to his neighbor. We had a joint checking account together but not with ROS. Which we didn't know about. Not having seen the will the bank told me the money was mine so I opened another account and froze the original one. Now he has taken over the original account again which leads us to believe that he was given rights to everything. Neither I or the bank were notified of this. I have sent for a copy of the will and the court clerk said that because he was left everything that the will did not have to be probated. Can we be sued?
