Legal Question in Wills and Trusts in Florida

I am the Trustee of the late mother's Trust. My brother is a beneficiary and is a homless drunk who refuses to get help. I have $10,000 of his money from the Trust that I would like to give him but I know we will just use the money to rent a cheap hotel and drink until all the money is gone. As the Trustee do I have any legal responsibility giving money to someone I know not to be of sound mind.

First, it depends upon what the Trust says. If you have no leeway, then there are few options.

One of the few may be if he is a danger to himself and needs medical assistance. That I can't answer for you.

There may be other options, but you will need to consult with an attorney to figure them out.
