Legal Question in Workers Comp in Florida

continued employment

Lynne is injured in March 2002 while driving a bus for her employer. She has been receiving workers Comp. Is she still considered an employee six months later, or did her employment terminate upon receipt of workers comp.??

Neither employment nor Workers Compensation ends simply because an employee files a claim or Petition For Benefits. The employer is statutorily foreclosed from firing an employee receiving Workers Comp just because they were injured and claimed benefits. Lynne should consult a claimant's work comp attorney to discuss her rights. Good luck.
