determinimg if workers are independant contractors or employees

I own a moving company. Those that work for me have a direct effect on the outcome of the move. I supply them with all the tools and padding they need to get the client's belongings from one place to another and they move, pack, wrap, and load the items. I own the moving truck as well, and most times I am present to oversee operations and handle the paperwork. The workers are responsible for their own personal insurance. Everything that I've read online says my workers are independent contractors, but I want to make sure I will not get in trouble by only giving them a 1099 at the end of the year and not taking taxes out. There is often a fine line between independent contractors and employees, especially when it comes to the IRS. There is a list of factors of how the IRS determines whether a worker is an IC or employee, including control of the work, method of payment, etc. To be safe, have an attorney sit down with you and review how you employee your help.
