Legal Question in Consumer Law in Georgia

Co-signer

We had a friend who was to co-sign for a car for me. They put her name on the paper work first then me as the co-signer. We kept telling them that she was the co-signer but they said in Georgia it didn't make a difference. Now the paper work is in her name and address so I don't know where they will send the payment book or tag. Who's name is suppose to be first on the paper work. Mine as the person who is getting the car or the co-signer?

Re: Co-signer

We do not know whose name is supposed to "go first" on the paperwork - we don't have it. The bottom line is that you should not sign a contract that is not correct. If so, the problems become your fault. From your post, it appears you knew it was incorrect and signed anyway.

Re: Co-signer

A co-signer and the maker are equally liable on a note. To answer the other question of who owns the car, we'd need to actually see the contracts. It could be both of you, or just one of you. The next time before you sign a contract you need to talk to a lawyer first.
