Legal Question in Consumer Law in Georgia

Beyond the Lemon Law Time Period

I have had my car in the dealership's service dept. 5 times for the same problem. The car still isn't fixed. The problem started 9 months into my first year of owning it and only had 15,000 miles on it. The GA lemon law states, "less than 1 year or 12,000 miles, which ever comes first." What are my rights and laws as a consumer to have this car fixed or be given a new vehicle if the problem happened just after one of lemon law criteria? Secondly, I have gone to arbitration regarding this problem. What are my rights and laws if I don't agree with the decision? I feel I have a defective vehicle which was purchased new in 98 and since my problem started at 15,000 miles, instead before twelve I have no recourse to force the dealership to fix the problem or provide me with a new vehicle or terminate my lease.

Re: Beyond the Lemon Law Time Period

Your questions are too complicated to answer in this format. However, you are correct in looking at the "lemon law", O.C.G.A. Sec. 10-1-780 et seq.

Best advice: contact a local attorney who can spend the needed amount of time to review your documents and discuss your case.
