I had a Chapter 13 in 1994 and completed it in 6/2000. My wife had a student loan that was not included in the plan due to being Government Guaranteed. We did not remeber about this note due to the length of the Banruptcy. Our Attorney told us when we came out of Chap 13 That any Debts not included in the plan would be contacting us to settle the balances. we never heard anything until 5 years later, with a collection agency about the Student loan. Do I have to pay all the fees and penalties that they are requiring. since I was not ever contacted Certified mail and they waited such a long period of time to contact us?

Ask your lawyer questions about your Bankruptcy case, and refer to your student loan agreement for questions about your loan. You will likely find that you should have been making payments for most or all of the time period at issue, without thm having to contact you but your loan agreements will likely address that.
