If a bank or a company decides to take legal action against an individual, and they chage the individual the court costs is it within the rights of the individual to refuse to pay the court cost. In my opinion, the individual is well within his rights to refuse to pay them and no legal course of action can be used to force him to pay. Because the company or bank CHOSE to take legal action, it does not become the responsibility of the individual to repay. Am I right or wrong?

There are several reasons a party may be assessed court costs, and even attorneys fees for the other party. The best answer is that if a lawsuit has been filed, and the court awards court costs, the party can either pay it, appeal, or request reconsideration by the Judge. Otherwise, right or wrong, it becomes a final order.

If you are sued and lose, the court will assess court costs against you. In some cases they also will assess the winning parties' attorneys fees against you.
