I Got Served....

I received a summons via sheriff from a credit card attorney's office. First of all, he ''served'' the papers to my 17 yr old sister. I owe 4000 that the collection agency stopped calling about 2 yrs ago. That's besides the point. On one of the papers, it says that I have 30 days to answer the summons and on another paper it states that notice is given that attorney's fees in the amout of 408 will be due and collectible 10 days from service. Please tell me what to do. I can't afford to pay it all at once, the lawyer's office is in ATL almost 2 hrs away, I don't have 408 to pay an attorney in 10 days. What are my options? Do I call the attorney's office? Is it possible to not need a lawyer?

When you ignore a debt you should expect to be sued. When you are served with a lawsuit you need a lawyer. You have 30 days to answer. If you fail to answer you lose by default and the creditor can soon after garnishee you or levy on your assets and bank accounts. If you do not pay in full within ten days, assuming the credit card agreement sets attorneys fees (and they all do), you will owe that additional amount.

Service on a 17 year old may or may not be valid. Discuss that with your lawyer.

Be advised that it is very expensive to defend a suit. It may cost more than what you owe, and you still may lose. You may be best served to pay a lawyer to see if either (1) he can negotiate a settlement for you, or (2) to file bankruptcy, if that is appropriate for you.
