Legal Question in Credit and Debt Law in Georgia

My husband has a defaulted student loan that he just found out about, after being told by the U.S. Dept of Education that he had paid everything in full. We want to start an LLC. Will the creditor be able to garnish or take any of our profit?

Maybe. They can garnish accounts, wages, and put liens on real and personal property. They have far greater leeway than other creditors and you can expect this will last quite a long time. The obvious solution - pay the debt. Your husband should have been aware of what he owes.
