Can you motion for a case to be dismisses and counter sue or ask to collect damages at the same time if so how do you do it or word it in the motion

Mr. Riddle is correct. Also, if you cannot afford a lawyer, you will have to read the rules and codes regarding counterclaims and motions to dismiss. Your current situation is not one where you can simply receive advice without a consultation.
