Legal Question in Criminal Law in Georgia

False Statement

If someone calls the police for a simple battery and make false statements were as the accused is charged with simple battery, terroristic threats, and cruelty to children, how would you go about clearing it up so that the charges are dropped?

Re: False Statement

As in any criminal case, talk to the prosecution and defend your case. You might also have a civil claim against those made the false statements. If you would like to discuss any issues further, please feel free to contact my office. My contact information is below. Thank you.

Re: False Statement

If the warrant has already issued and bond has been made, the first step would be to see if the court would grant a preliminary hearing even though bond has been posted. If not, a pre-arrest hearing or preliminary hearing should allow you to have the charges dropped if there truly is no basis for the charges.

Even if the court finds probable cause, it will allow you to develop the case for purposes of a trial.

Call if you wish to discuss this matter further.
