Legal Question in Discrimination Law in Georgia

terminiation without reason

After working for a company for 4 years doing everything and doing a good job i was

terminated without reason, the females of the company (2) were gender discrimated against i believe because the men got paid when they were off sick, we did not

The men got 2 15 minute breaks a day we got none. I took classes to keep up with new computer tecnology. I believe my age 57 had something to do with it the boss has now hired (she was being trained before i was terminated) and he stated she was better qualified and better trained than me. i have really run the office for 4 years until the new boss came 6 months ago after firing the old boss for stealing which i had nothing to do with the stealing, but they could not have fired the old boss without my help because so to speak i knew where all the bodies were buried.

do i have any recourse

Re: terminiation without reason

I agree with Kelly's advice. In addition, beware that you only have 180 days from the date of the discriminatory conduct in which to file a claim of discrimination with the EEOC. Judging from the date of your question post and assuming that you were recently terminated, I would assume that you still have some time to file a claim for discrimination based on your termination. However, any pay disparity arising more than 180 days before filing might be barred, unless you can show a "continuing violation," which has a specific legal meaning. I would suggest that you contact an attorney as soon as possible to discuss your options. If you have any specific questions, please feel free to call or e-mail me.

Re: terminiation without reason

You raise several issues. As to sick pay and breaks, it would be a violation of federal law (Title VII of the Civil Rights Act of 1964) for the terms and conditions of employment to be determined soley by gender. In addition, to terminate someone because they are over 40 would violate the Age Discrimination in Employment Act. These federal laws are enforced by the EEOC. You may want to speak with a local attorney who deals with employment discrimination or your local EEOC office in Atlanta. If you need help reaching the EEOC send me an e-mail and I will provide you with a name and number.
