The night before

If you are involved in an accident and the night before you had been drinking can you still be charged with a DUI through a blood test?

In Georgia, if you are involved in an accident with serious bodily injury, or if the officer has probable cause to arrest you for DUI, he will request an official state test. In your case, he requested a blood test. If the blood test comes back positive for an unlawful blood alcohol level, or if it comes back positive for some other prohibited substance (drug), you can be charged with DUI.
