child custody

My son went to live with his dad when he turned 14 and now has legal custody, my son wa told by his dad that he could seehis me anytime now that he is there nothing is what he was told it would be.. I want to get my son back in my home.. How can I legally do that if he chooses me to live with?

Re: child custody

Your son could sign an affidavit stating his desire to return to live with you and you could file a petition to modify custody based on his election. Please be aware, though, that his election is no longer binding on the court and the judge could decline the request if he or she feels it is not in your son's best interest to change custody.
