Want Custody of 5yr old Autistic daughter, but never married to her mother.

I just want to know what I would need to do to get custody of my 5yr old autistic daughter from her mother. I am not legitimized, so I'd like to know how to do that as well. I don't have a lot of money, but any info would help.

Generally speaking, an illegitimate father has no access rights, only a duty to support. You need to file a petition for legitimation as soon as possible since the child is five years old. It's possible to lose your right to legitimate if you wait and lose your "opportunity interest." Custody cases are usually complex and last a long time so you should hire an attorney. Each case is different so you need to find an attorney to discuss the issues surrounding custody of a child. If you haven't been exercising visitation and you are a stranger to the child, you might have a difficult time getting custody.

You need to file a petition to legitimate and custody. Hopefully you have been financially supporting the child and have established a relationship with the child. This will make your case stronger for custody. If the court does not grant custody, you need to make sure you are awarded visitation rights.
