my daughter is in jail with a 21 month old baby, can I get temporary guardianship without her signature

I will assume the father is not in the picture or he is unable to step forward and take the child. You can file a deprivation action in Juvenile Court as the child is without parental care. I would suggest contacting an attorney as it can become complicated if a parent objects which I assume will happen since you are asking if you can obtain guardianship without your daughter's signature. There is also the father to deal with.

If the father isn't in the picture you have a better chance than if he is. The father has a potential say-so, depending on whether he is around and has legitimated the child. You need to sit down with a lawyer and weigh all the pros and cons.
