Father's Rights

The father of my child has lived out of state the entire 8 years of my son's life. He has never been in the child's life and my child has no idea who he is. The father is not on the birth certificate and has never paid child support. He is recently released from prison and is now making contact. I am now married and my husband who has helped raise my child wants to adopt him. Do we have to contact the biological father if he is not on the birth certificate?

The father's rights either must be terminated or he must consent. Both ways require contact with the father.
