Can my husband adopt my daughter even if she has her biological fathers last name and he signed the birth certificate, but is not on child support.

Generally, an adoptoion is possible if the father either (1) consents or (2) has failed to pay support or see the child for an extended period, usually over a year. An attorney can assist you in either case.
