Where is my lawyer?

A friend of mine has a lawyer that she is using to attempt to get a divorce. They retained him in October to represent them. The lawyer rarely calls her back and has done almost nothing in the case other than send a bill for services that are questionable as to whether they were done or not. Is there any recourse if you retain an attorney and they do not do the job they were paid to do?

Much as I hate to say this about fellow lawyers, there are bad apples in the barrel, just like there are bad plumbers, etc. Personally, I like to see disputes between attorneys and clients resolved so that both sides can feel that a fair resolution has been reached. Unfortunately, this can't always happen. I would suggest that you call the State Bar of Georgia's Executive Director (404-527-8755) and request the form for filing a complaint against an attorney. I would then fill out the form and send a copy to the attorney stating that within a reasonable period of time (ten days or so), if a response as to acccountability is not received, the form will be finalized and sent to the State Bar.

Another action, loathe as I am to mention it, is a legal malpractice action against the attorney if the client has been harmed by the actions, inactions or malpractce by the attorney.

If you are not happy with your current attorney, you can seek to have him or her withdraw from the case. You will then be free to retain other counsel.
