Legal Question in Family Law in Georgia

Taking over custody

My ex-husband is currently imprisoned on the charge of ''lewd and lasivious behavior with a minor under the age of 16'' , he had custody of our 2 children, they are currently with me in Geogia. I want to know how I go about getting permanent custody in this state. I can't seem to find any legal forms I need, and the clerk of court is of NO help.

Thank you very much!

Re: Taking over custody

You would need to ask the court to modify the custody decree based on the new circumstances. You would file a motion to modify. I would strongly suggest hiring local counsel to assist you. It can be tricky.

Re: Taking over custody

A change of custody is far too important to risk messing up via do it yourself. I strongly would suggest that you obtain counsel and do it correctly.

Clerks of court are not permitted to give you legal advice.
