Legal Question in Family Law in Georgia

My wife and i have decided to get a divorce. we are also planning to file chapter 7, do we need to wait to file divorce papers after filing bankruptcy papers. we only have one thing we both have our name attached to and that is our house and second mortgage. with the economy as it has been, we are probably (most likely) going to lose the house. all others things are seperated, nothong else jointly.

It is very important that you not do this yourself, and go to a lawyer that handles both type cases (my office does both if you are in metro Atlanta).

You may be able to save a great deal of money doing the bankruptcy first, but the decision as to an order of filing and whether you should (or can) do a joint case is complex, and involves factors including your respective incomes, what other debt you have, and other issues.

There are also complications as to doing both cases at once that will vary depending on the specific facts of your case.
