Legal Question in Medical Leave in Georgia

Being required to us FMLA for doctors appointments

My wife's employer is now insisting she use FMLA time for any and all doctors appointments. Can they require her to do this? Up to this point she was paid for what ever time she may have missed due to the appointment due to her being on salary.

The short answer is yes, the employer probably can do this. However, the larger risk the employer runs is making her into a nonexempt employee. This means that if she works overtime, she may have to be paid for it.
