change the agreement and adding own's version

An area contractor was hired by by husband and was paid half down to finish a pond we had started,the rest on completion. anyway we're not happy with the outcome and ask contractor to do it the way he agree to before contract was sign and passed. now civil court hearing is approching and he is counter sueing for theft of service and he change part his version of contract and added no warrenty, but it not on our copy. what laws are on our side and can we bring up in court?

Your pending case can't be handled through a message board by people who know nothing about your case. If you don't understand the case or legal process, you need to hire a lawyer. This is especially the case if the other party has a lawyer. If it is small claims/magistrate court, and you choose to not retain a lawyer, the Judges are used to people simply stating their side and providing copies of all documents.
