Does a father have to marry the mother before or after to legitimize the child or children?

Neither. The father would file for legitimation with the superior court.

No, the father doesn't have to marry the mother. Also, if you want custody/visitation, you should think about handling that also in one proceeding. If you aren't already paying child support, this will be resolved in the action.
