Legal Question in Civil Litigation in Georgia

Not fulfilling rent obligations

there are 3 people on our lease for renting a townhome. we all signed the lease and there is 1 co-signer. one of the renters left the premises early on his own free will and did not pay his full portion of the last months rent. there was an attempt to get someone else to move into the premises to cover his last months rent, that did not work out, so the obligated person did not pay all of his rent. it was agreed by all three of us that the remaining 2 of us would split utilities and he would just pay his rent. he did not do this. can i take him to small claims court to attempt to obtain this money? thank you for your time.

Re: Not fulfilling rent obligations

If there was an agreement to share the expenses, you can sue in small claims court. However, you still are responsible for payment of the rent under the lease.
