Legal Question in Civil Litigation in Georgia

Garnishments

My mother recently won a civil suit and was awarded $900.00, she is now trying to collect the money so she went to have the loosing party's wages garnished, however she was told that she could not because he filed bankruptcy in 2005 and already has other garnishment coming out. Why would she not be able to garnish his wage and is there another route she can go to get her money?

Re: Garnishments

It appears you have been provided reasons her wages cannot be garnished. The other options might include looking for bank accounts or other unexempt personal property, most of which includes time consuming work, dead ends and similar problems. If the debt arises before the BR case was filed (regardless of judgment date), your Mom might be violating the law by attempting to collect.
