You would simply need your spouse to petition for you to obtain your greencard. However, you should consult with an immigration attorney to make sure that you have no inadmissibility issues. For a free consultation, please call my office at 1-800-408-5818.

If you entered the country with inspection (with a visa), you are eligible to adjust status to lawful permanent resident based on your marriage to a U.S. Citizen. If you did not enter with inspection, you will need to process your application through a U.S. Consulate abroad with a waiver. The waiver must demonstrate that your U.S. Citizen/Lawful permanent resident spouse or parent would suffer extreme hardship if you were not able to return to the United States. You should speak to an immigration attorney to go over your options. Please feel free to contact me for a consultation.
