Legal Question in Immigration Law in Georgia

Iam a foster parent. I have a child that has lived with me since 11/08. The judge terminated parental rights a few months ago. The child was born in the UK but was never registered with the US there. The childs mother was a US citizen. She brought him here on a visa that expiered a month after he was taken into state care. We have now been approved to adopt this child but the state says they can not nationalize him that the "parent" has to do that. His lawyer which is not great says that we could adopt him today and he could be deported tomorrow. And that the US gov't might not nationalize him due to his visa being expired and him living here illigally even if he was in the states care. Which puts us in a bad spot not to mention the costs involved that we are not ready for. Can the state get his citizenship worked out ?
