I applied for a job at the company I currently work at that I was over qualified for, per the person that interviewed me. I actually had to go to HR because the person who interviewed me did not want me to apply because I was over qualified. Anyway, the position was given to a person who was not only less qualified, but also has less seniority. I’m just wondering, from a legal perspective, would that be considered discrimination and if so, what should I do?
There is almost always "discrimination" in hiring, firing, and promotions. However, being "overqualified" is not a legally protected class like race & gender. There is no general legal entitlement to a job or promotion.
