Legal Question in Employment Law in Georgia

How does a criminal background check work in Georgia? What I am confused about is when the situation says something to the effect of "convicted of in the past 7 (or sometimes 10) years". When the check is done, doesn't it pull everything? And if so, how do you know the employer doesn't take into account everything on it, and not just the time frame specified? Also, I have heard that employers are not permitted to look at background checks farther than 7 years if the position pays less than 25k - is that correct? And again, how do you know they only honestly judge on the past 7 years? One more thing, is "nolo contendre" (sp?) considered a conviction in Ga? Thank you for any advice you can give on exactly what can be seen and used.

No one here can guess what a particular report says or does not say, and an employer can generally use any information they have to make their decisions.
