my drunk boss assaulted me

I am a assistant manager in a large resturant chain. My Genaeral manager came in to work on his off day drunk. We started arguing and then my boss pushed me and tried to forcefully drag me outside to be alone.I immediatly reported him to our department of human resources manager. I was told to go back to work as normal. My boss is being transfered to another store. This is not the first time my boss has come to work drunk and had complaints made against him to the company.I know if i would have gone to work drunk and assaulted someone i would have been fired immediatly. why didint they fire him?? is that fair ???

other managers in the company have been fired on their first offense for the same thing, why not my boss ??

What can i legally do ???

No, your company is not absolutely obligated to handle him in the exact same manor they have handled other employees, although to try to do so is usually a good idea. You don't know what all has been said between them---perhaps he has agreed to rehab and counseling and others have not.

You said he had complants about him before, but you didn't say exactly for what. Being drunk at work? Being abusive? Or actually hitting or pushing people on other occasions.

You certainly have at least a small lawsuit against him for assault and battery, and maybe also against the company for negligent retention if he has done similar things before. But, does he have any money to collect? Do you want to sue your own employer?
