Legal Question in Medical Malpractice in Georgia

Gastric Bypass Surgery Mistake

A friend of mine had gastric bypass 3/97. Something happened in the initial surgery resulting in a 15 mo. hospital stay, 7 surgeries and a discharge date in 5/98. He was discharged as a bedridden patient and subsequently died in 7/99. His wife hired attorneys in 6/97, feeling that something had gone wrong. By 9/99 the attorneys had done very little with the case and she elected to dismiss them. She was under the assumption that a med mal case against the hospital and surgeon was underway. They told her at that time, they had let the time lapse on filing the med mal case against the hospital. Then they sent her a bill for $90,000 for their ''services''. Is she responsible for paying this bill, can she sue them for their negligence and if so, what is the time frame under the GA law.

Re: Gastric Bypass Surgery Mistake

A thorough review of all the facts needs to be done, but it certainly sounds like a potential legal malpractice case. Please feel free to give me a call if your friend would like to discuss.

I think you need to speak to a legal malpractice attorney. I would recommend David Bills. I am not in the office now but can give you his number tomorrow if you need it.
