Legal Question in Medical Malpractice in Georgia

I am suing a Nursing Home -- my Aunt broke her hip and they allowed her to lay in bed suffering for a week before sending her to the hospital. My attorney told me that he gets 50% of the settlement and that I will only get 5% as administrator, since the rest will go to her 'closest of kin' which will be my Aunt's 80 year old sisters, who know nothing of this lawsuit. How does the state of Georgia determine who the closest of kin is. Do they do some sort of family tree search or what?

IN addition to you not being clear, it appears it is not a medical malpractice question (and if it was, you obviously have a lawyer for that). You still have not addressed the question raised the last time you posted - why you apparently believe the money is not to be used for your aunt's care (or if she has died). Either way, you need a lawyer - a probate lawyer, or an elder care lawyer (that you and your aunt should have seen long ago) -- because there are still big red flags from your posts.
