Legal Question in Military Law in Georgia

Soldier Moving on Post

I am a SGT in the military and I have a soldier that is moving on post because he has a child. He doesn't have a court order for visitation but the child's mother and the soldier has a notarized letter agreeing to him having custody six to eight months a year. My 1SG is trying to give me an article 15 stating that I falsified documents to get this soldier extra money. The soldier is moving on post so he isn't seeing any of the money. The child is also on his deers. I made sure the soldier had what the S1 asked for and they submitted all the paperwork. Is this legal or right what they're trying to do to me?

Re: Soldier Moving on Post

If you did not knowingly assist the Soldier with or advise the Soldier to falsify documents or make false assertions, I cannot imagine that your command has a sufficient basis to pursue an Article 15. See U.S. Trial Defense Service input without delay, or consider calling a civilian attorney experienced in military justice matters.
