Legal Question in Personal Injury in Georgia

Auto Accident

I was involved in a 2 car accident in Nov. 98. The other driver was cited. The driver was 17, he was charged with reckless driving and DUI. He was not the owner of the vehicle, the owner was his passanger. I went to the hospital that night and recieved pain pills for dicomfort. I saw a doctor who made a diagnosis of neck and back trauma from the accident and refered me to a neurologist. The neurologist determined I had sustained a soft tissue injury of the neck and back(C 5 membrane).

I began physical thearpy and continued until Jan. of 2000. All of this while waiting on a settlement from the insurance company (we are both insured through the same company). I began seeing a chiropractor in June 00 for neck and back pain. I was required to have an MRI which revealed a spinal injury, disc and vertibrea damage as well as 3 pinched nerves. Later in the week my attorney said the insurance company had agreed to a settlement (BI $25,000), after attorney fees and medical payment my portion is $8,000. I have about 4 months before the Statue of Limitations expires (I think), my lawyer seems pleased with this settlement. Because of recent problems with my injury I am hesitant to settle. Any advice???

Well I am not going to second guess your lawyer.

It sounds like the limits on the policy are low and you had some significant expenses during the case. Given you lack of hard injuries (broken bones) the settlement is well within acceptable limits.

Without more information, such as the policy limits, reviewing the medical records, your prior injury history, it is hard to answer your question. You may want to ask another lawyer to review the file and pay for his time to get a second opinion.
