I would like to know can I make a claim against my insurance company for pain and suffering.If I lost to defendant in court ? We both had same car insurance company..

Yes. The fact that you both have the same ins. company is not relevant to your legal rights. Whatever you could claim with different ins. co.'s you can legally claim with the same one.

Generally you will not be able to make a claim against the insurance company for pain and suffering. One instance in which you would be able to sue your insurance company would be if they acted in "bad faith" with respect to the handling of your claim. Why is it that you want to sue your insurance company when you lost your case against the Defendant? Please provide me with more information. Thank you.
