Legal Question in Personal Injury in Georgia

Payment of insurance deductible

13 year old lying on ground at school had friend throw a quarter that went down her throat (not on purpose). Should that childs parents be responsible for paying 150.00 deductible for my insurance? Can they be legally liable to pay?

Re: Payment of insurance deductible

While it would be the polite thing to do and most might suggest the moral thing to do, it is not the legal responsibility of the parents to pay under the law and the facts of the situation as you have stated them. There is a legal responsibility for parents to be responsible for acts of malicious mischief committed by their child under certain circumstances and up to a certain dollar limit, but there certainly was no maliciousness, nor was there even mischief when the child's act in tossing the quarter was at the request of the other child.
