Legal Question in Personal Injury in Georgia

Train Accident

My uncle was killed last year by a subway train and I'm wondering if this is a possible case. From what I can ascertain so far, it seems that the subway security did not catch him when he was walking the wrong way. He was an elderly(over eighty years old) gentleman. I want to know if this seems like a case.

I deeply sympathize. My own grandfather was hit by a train as a young man, and lived another 60 or so years with significant brain damage that radically changed his life and the lives of everyone in the family.

I assume this involves MARTA, since that is the only subway system in Georgia. If he was walking on the MARTA track, the defenses of contributory neglience and assumption of risk may be insurmountable. What actual opportunity did MARTA security have to get him off the track?

First please accept my condolances for the loss of your uncle. I need to find out more before I can give you a more definite opinion. That said I do think there is the possibility of a meritorious claim. How did he get on the tracks? I am sorry to hear of your grandfather's tragic death. Unfortunately, you have not provided enough facts concerning the incident for me to advise you properly.

Did this incident occur in Georgia? Had your grandfather been a passenger on the train? Also, it would need to be determined who has the right to bring the case (if there is a case).
