Legal Question in Real Estate Law in Georgia

We entered into a contract to purchase a home with the rent to own option. we paid $3000 non-refundable down payment, now the home has been foreclosed on, HUD is buying the home and we have to vacate the premise, therefore there has been a breach in contract, can we recover the deposit

That depends of two things:

(1) The language of the contract, which you did not share with us, and which contains the answer, and

(2) The practical question - how do you plan to collect from someone who got foreclosed on?
