Legal Question in Real Estate Law in Georgia

HOA demanding that I change window treatments

My HOA sent me a notice stating that I must change my current window treatments to white or off white. I have lived here for 5 years and have had the same window treatments. This covenant was not listed in the bylaws I agreed to when I moved here. I was informed that the bylaws had been changed to include this but I was not informed. What are my legal rights to fight this? I do not have money saved up to change all of my window treatments. However, they are threatening fines and leins if I don't comply.

Regretably, I cannot answer your question without examining several documents. The fee for the work that I need to do is fairly predictable. Call me next week if you want to disucss what is involved.

You need to have your covenants and bylaws reviewed by an attorney familiar with this type of work. Consult with a local attorney.

Re: HOA demanding that I change window treatments

Before paying a lawyer money you said you do not have (and still may have to spend on windows), read the agreements and ask the HOA officers to specifically point out their basis for the request. You may find the agreements allow them to make some changes from time to time, or they may back down.
