Legal Question in Real Estate Law in Georgia

moving out with no signed lease

My daughter age 19 moved in a house with a friend. The friends father pays for the house. The girl told her to just help pay utilities. During the few months my daughter lived there, the water, cable tv and electricity were turned off due to the girl not paying the bills. My daughter gave her some money, but nothing on a regular basis. At the time the girl said it didn't matter. The girl does not work. My daughter does. My daughter moved out and left her a note that she could not live with the cigarette smoke and her lack of motivation. She also wrote that she would give her some money when she can since she just started a new job. Now the girls father is calling and threatening my daughter to sue her. For what I don't know. All she owns is a car which she makes payments on. He threatens that he will see her in magistrate court. I feel he is just trying to intimidate her. There was no lease signed, just verbal conversations with 2 witnesses. The girl has also called and told her if she didn't give her money by today her father would take legal action.

Can he do anything? Thanks for your help.

I doubt that he would be successful. However, I would advise you to contult with a local attorney. All of the facts need to be discussed, which is difficult to do in this type of forum.

Re: moving out with no signed lease

A wriiten and/or signed lease is not a prequisite for a lawsuit. As long as he has a basis to allege that there was an agreement between the girls and that agreement was breached, she could file a claim.
