Legal Question in Sexual Harassment in Georgia

private school claims this is not sexual harassment

Is this sexual harassment? School continues to employ this teacher. There are many incidents that have happened over many years. Some people have complained some have not. Here is a short list. I will leave out certain words. 1.Middle school teacher stretches against wall and tells my son he is stretching his ''blank''.Tells him the importance of making it longer and comments on his own size.2. to a student, your writing makes me want to stick my ''blank in your mouth.3.to a student,my ''blank] is longer , do you want me to take you in my office and prove it.4.to a male student[referring to a female student]you want to blank her dont you 5.to a faculty member, should I whip out my blank, stick my glasses on it and have you take a picture of it.

The school claims this is not sexual harassment. I think it is. Let me know what you think.

Re: private school claims this is not sexual harassment

The conduct certainly appears to constitute a sexually hostile environment. Understanding that this is a private school, are you aware of whether the school receives any federal funding? Title IX protects students from sexual harassment in schools receiving any federal funding. There are other theories which might be explored for private schools receiving no federal funding.

Please feel free to contact my office with any additional questions.

I am never one to recommend getting the police involved in something that is arguably a civil matter, but if my child came home and told me a teacher said these things, I'd be down there with a police officer fairly quickly. A teacher who says these things has no business near a children or a classroom.
