Father died without a will

My father passed away without a will, we have discovered that he may have pension benefits from previous employer. I have a sister but we are not close and have different Mothers we did not grow up together therefore do not know each other. How do we get our father's debts paid and receive the pension amount. We have been told by the company that an executor needs to be set up, is that an attorney or can we both be executors.I would like to make sure that after our father's bills are paid and if there is any funds left that they are split between us evenly.

My condolences on the death of your father. This will all go smoother for you if you hire an estate attorney to handle the procedures for you and advise you of your options. The administrator will need to be appointed by the court; however, it is not necessary that that individual be an attorney.
