father passed without a will

My father passed witout a will. There are 2 living children left. My older brother which lived with my father in dads house has taken over ever thing without probate. All I got was his truck. What do I do to start the process of spliting his estate.. My brother claims he is the oldest so he gets it all. Please help,

Your brother is wrong. Age has nothing to do with it. There being no Will, the estate may have to be administered. (Probate refers to the situation where is a Will.) Consult with a local attorney.

You don't own the truck and he doesn't own anything either. Until one of you gets a lawyer and probates the estate, nothing is resolved.
