Legal Question in Wills and Trusts in Georgia

Can I probate my father's estate even though his mother and father's estates have not been settled? In the probate papers I have to list all of my father's assets. He is entitled to a 1/4 share of both his father's estate and his mother's estate. Do I list this 1/4 share as part of his assets even though those estates are unsettled and no distributions have been made? (i.e., my father's estate has no deed or title to any of this land yet.)

As an executor or administrator you have a duty to marshall all the assets and those are assets. You should be using a lawyer to assist you and he will tell you how to address this issue.
