Is probate required?

When is a will required to go to probate in the state of georgia? Does it depend on the amount left by the will or other circumstances or are all wills required to go through probate in georgia?

Wills are not required to be probated, but a will is required to be filed in the probate court of the county where the testator was a resident within a "reasonable amount of time", after the testator's death. Normally a will is probated if there are frozen assets that require Letters of Testamentary before the assets can be brought under management by the Executor. Bottom line, should you probate the will, it depends upon the circumstances and parties involved.
