Legal Question in Workers Comp in Georgia

amt one can draw for weekly compensation

My adjuster tells me I can only draw $450 a week. One attorney told me I am allowed to draw 2/3 of my average salary before being injured. If this is true, my avg wkly salary was $830 and 2/3 of that is $560. Why am I only getting $450 a week.

Re: amt one can draw for weekly compensation

Unfortunately, the adjuster is correct. Pursuant to Georgia law, the cap on weekly benefits is $450.00. Keep in mind that you do not have to pay income taxes on your weekly indemnity benefits.
