deposition

do i have to give a deposition to an insurance comanysys attorney. or do i need to refuse. i gave a recorded statement to the insurance company a year ago. now their attorney wants a deposition a year after the fact.

You will probably be forced to give a deposition. If you already have an attorney representing you, you will need to discuss this issue and your concerns with him or her. If you do not have an attorney, there must be some issue going on in your claim where you have recently requested a hearing. The deposition is the insurance company attorney's opportunity to find out exactly what the current issues are and to question you about what evidence you plan to present when you go to the hearing. Even though you may have given a recorded statement one year ago, depending upon exactly what has happened, the attorney probably has the right to take your testimony in a deposition about your history, your claim, and your current status.
